These Terms of Service ("Terms") govern your access to and use of Runaway Sculptor("we," "us," or "our"), including the Runaway Sculptorvirtual reality game (the "Game") and this website (https://runawaysculptor-webapp.vercel.app, the "Site"). Together, the Game and Site are the "Services."
By downloading, installing, launching, playing, browsing, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Additional platform terms
The Game is distributed through third-party storefronts (for example, Meta Horizon Store). Those platforms' terms, privacy policies, age requirements, and acceptable use policies also apply when you acquire or use the Game through them.
What Runaway Sculptor is
Runaway Sculptor is a collaborative, in-person party experience: one player sculpts prompts in VR while others watch on a nearby display (such as a TV, phone, or computer) and compete to guess the word. Sessions are offline and local to your gathering; headset use passes between players round by round.
Instructions in the Game may explain how to use your headset's built‑in or system‑level casting or mirroring options. Casting happens on your devices and platforms; we do not operate casting for you or receive your cast content.
Eligibility
If you accept these Terms on behalf of a household, gathering, or organization (for example when setting up hardware for guests), you represent that you have authority to bind that group to these Terms. Adults should supervise minors. You must also meet any eligibility and age requirements imposed by our distribution platforms or devices.
Limited license
Subject to these Terms (and applicable store terms), we grant you a personal, non‑exclusive, non‑transferable, revocable license to access and use the Game for your personal, non‑commercial entertainment and to browse the Site for lawful purposes.
You agree not to:
- copy, reproduce, publicly display, publicly perform, or distribute parts of the Services beyond what applicable law expressly allows or what we expressly permit;
- attempt to circumvent technical protections, scrape the Site at scale in a way that burdens our hosts, interfere with normal operation or other users' enjoyment, probe or attack our systems except as part of an authorized coordinated disclosure process we agree to in writing,
- use the Services in violation of applicable law or third‑party rights, or to develop a competing clone by extracting assets or substantially similar expression where not permitted by law.
Gameplay content and acceptable use
You control what you sculpt in VR. Sculpted forms and guesses may incidentally resemble words or symbols chosen by participants. You are responsible for lawful, respectful gameplay (including not using the Game to harass, threaten others, or display illegal content to your audience via casting). Participants should respect the comfort and boundaries of everyone in the room, including regarding motion, volume, sharing the headset, and what appears on secondary displays.
Intellectual property
The Game, Site, logos, visuals, trademarks, underlying software, audio, and related materials ("Our Content") are owned by Runaway Sculptor or licensors. Except for the limited license above, no rights are granted. Do not misuse Our Content.
Disclaimer of warranties
The Services are provided "as is" and "as available." To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non‑infringement. We do not warrant that play will be error‑free or uninterrupted or that casts or secondary displays will work on every device combination.
Limitation of liability
To the fullest extent permitted by applicable law, Runaway Sculptor will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits, lost data, or business interruption arising from these Terms or the Services—even if advised of the possibility.
Except where prohibited by law, our aggregate liability for any claim arising from or relating to these Terms or the Services is limited to the greater of (a) the amount you paid us for the Game in the twelve (12) months before the claim arose, or (b) fifty United States dollars (USD $50). Some jurisdictions do not permit certain exclusions or limitations above; in those jurisdictions our liability will be limited to the maximum extent allowed.
Indemnity
To the extent permitted by law, you will defend (if we elect), indemnify, and hold harmless Runaway Sculptor from claims arising from your misuse of the Services or violation of these Terms—but not where our own gross negligence or willful misconduct is the prevailing cause where such exclusion is required by applicable law.
Changes
We may update these Terms. If we revise them in a materially significant way through the Site, we will revise the Effective date above when we post an update. Continuing to use the Services after posting means you accept the updated Terms, except where a platform requires separate consent processes.
Termination
Your license ends when these Terms terminate. We may cease offering the Site or suspend support paths that we operate. Store platforms may revoke or limit access independently.
Governing law; disputes
Applicable dispute resolution provisions may vary by platform and compulsory consumer‑protection law in your jurisdiction. Where not displaced by mandatory law or platform‑mandatory dispute terms, courts with jurisdiction where we operate may resolve claims we cannot settle informally. You may bring a claim in your local courts too when required by mandatory consumer protections.
Miscellaneous
If some part of these Terms is unenforceable, the remainder stays in force. No waiver of a breach is a waiver of any other breach.
